1. Acceptance of Terms

By accessing or using PropBrain ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

PropBrain is a real estate investment analysis platform that provides calculators, AI-powered insights, rent estimates, property comparison tools, and related features. The Service is provided "as is" and is intended for informational purposes only.

PropBrain does not provide financial, legal, or investment advice. All calculations and AI-generated insights are estimates and should not be the sole basis for investment decisions. Always consult qualified professionals before making real estate investment decisions.

3. Account Terms

  • You must be at least 18 years old to use the Service.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and complete information when creating your account.
  • One person or legal entity may not maintain more than one account.

4. Subscription and Billing

PropBrain offers a Free plan and a paid Pro plan. By subscribing to the Pro plan:

  • Free Trial: New Pro subscribers receive a 7-day free trial. You will not be charged during the trial period.
  • Billing: After the trial, your subscription renews automatically on a monthly basis. You will be charged at the beginning of each billing cycle.
  • Price Changes: We may change subscription prices with 30 days' notice. Price changes take effect at the start of your next billing cycle.
  • Payment: All payments are processed securely through Stripe. You agree to provide accurate billing information.

5. Cancellation and Refunds

  • You may cancel your Pro subscription at any time from your account settings.
  • Upon cancellation, your subscription remains active until the end of your current billing period.
  • We offer a 7-day money-back guarantee for new subscribers. If you cancel within 7 days of your first payment, you will receive a full refund.
  • After the 7-day guarantee period, no refunds will be issued for partial billing periods.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated means to access the Service without our permission
  • Resell, redistribute, or sublicense the Service without written consent
  • Upload malicious content, viruses, or harmful code

7. Intellectual Property

The Service, including its design, features, code, and content, is owned by PropBrain and protected by intellectual property laws. You retain ownership of any data you input into the Service.

We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

PropBrain is an analysis tool, not a financial advisor. We make no guarantees about the accuracy of calculations, AI insights, rent estimates, or any other analysis provided by the Service. You are solely responsible for your investment decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPBRAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your account at any time for violation of these terms. Upon termination, your right to use the Service ceases immediately. Sections on intellectual property, disclaimers, limitations of liability, and governing law survive termination.

11. Changes to These Terms

We may modify these terms at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes arising from these terms or the Service will be resolved through binding arbitration, except where prohibited by law.
